Why fold it at all?
Because the alternative is unscrewing a light at a busy ramp in the dark. A folding arm drops flat for the drive home, clears a low garage doorway and stops the pole catching a branch or a mooring line. That is the whole case for it.
Does the hinge become the weak point?
It can, in salt air. The hinge is the only moving part, so rinse it when you rinse the boat and hit it with a lubricant that stays put when wet. Also check it actually locks upright before you leave the ramp, not halfway out.
Is folded the same as legal?
No. Folded down it shows nothing useful, so it has to be locked upright any time you are at anchor or under oars after dark. Get in the habit of raising it as you launch rather than remembering once someone is bearing down on you.
